The only way for us to optimize the contents of the NETCONOMY GmbH website to better meet your demands is to identify which sections of our website are most visited and on which the most time is spent. The following provides general information on the collection of personal information when using our website. Personal information includes all information that relates to you personally, e.g., name, address, e-mail address, user behavior, etc.

Information shall not be forwarded to third parties outside NETCONOMY GmbH. The only exception hereto are the subsidiaries of NETCONOMY GmbH.

Legal basis for each processing activity might be different, depending on the purpose of processing personal data. That is why legal basis is specified in the relevant sections of this Privacy Statement. In general, we are using the following legal basis:

  • Article 6, paragraph 1, item a) of the GDPR forms the legal basis for any consent we obtain from relevant persons for the operations involved in processing personal information; and
  • Article 6, paragraph 1, item f) of the GDPR forms the legal basis for any processing necessary to ensure a legitimate interest of our company or a third party, as long as such processing does not outweigh the interests, fundamental rights and fundamental freedoms of the person in question.

6. Data deletion and retention period

The personal information of the relevant person shall be deleted or locked as soon as the purpose for which such information was stored is no longer applicable. Storage beyond this period is possible if provided by the European or national legislators in the laws or other regulations to which the data controller is subject to. 4. Legal basis for the data processing

The legal basis for the temporary storage of data and log files is Article 6, paragraph 1, item f) of the GDPR – legitimate interest of the data controller.

5. Purpose of data processing

The IP address must be temporarily stored by the system in order to enable the delivery of the website to the user’s computer. To that end, the user’s IP address must be stored for the duration of the session. IP addresses are required for problem diagnosis, website administration and demographic information.

The information recorded is solely used for data security reasons, specifically to prevent attack attempts on our web server as well as for statistical analysis.

6. Cookie information

We use small text files called ‘cookies’ which are placed on your hard drives to assist in personalizing and enriching your browsing experience by displaying content that is more likely to be relevant and of interest to you. If you are uncomfortable with the use of cookies, most browsers now permit users to opt-out of receiving them. We use the necessary cookies regardless of your consent. They are necessary for the website to function and cannot be switched off in our systems. The legal basis for the processing of personal information when using cookies is Article 6 paragraph 1, item a) of the GDPR – website visitors consent, except for the necessary cookies, where we are relying on Article 6 paragraph 1, item f) of the GDPR – legitimate interest.

5. Purpose of data processing

Cookies that are necessary for technical reasons are used to make the website easier for users to use. A few functions on our website cannot be offered without using cookies. In those cases, our system must be able to recognize the browser again even after a user has switched to a different site.

The user data collected by cookies required for technical reasons are not used to create user profiles. In addition, we are using the cookies for a better performance of our website and for advertising purposes.

6. Retention period

a) Google analytics

We use Google Analytics, a web analytics service provided by Google Ireland Limited, Google Building Gordon House, 4 Barrow Street, Dublin, D04 E5W5, Ireland (“Google”). Google Analytics uses a functional cookie. Google Analytics also creates a Remarketing Tag to retarget a user via Google Ads, which is an advertising cookie.

It cannot be excluded that the collected information may be transferred to a Google server in a third country and saved there, especially a server of Google’s parent company, Google LLC, based in 1600 Amphitheatre Parkway, Mountain View, California, USA. In that case, personal data will be transferred to the USA based on Article 46 paragraph 2 item c) of the GDPR – standard data protection clauses adopted by the European Commission.

The IP anonymization function is activated on this website and Google will shorten your IP address prior to storing it; this shall be done for all member states of the European Union or in other states where the agreement pertaining to the European Economic Area applies. Only in exceptional cases will the full IP address be sent to a Google server in the USA and shortened there.

On behalf of the operator of this website, Google will use said information to analyze your use of this website, to create reports on website activities and to provide other services affiliated with the website usage and internet usage for the operator of the website. It this case, pseudonymous user accounts can be created based on the processed data. The IP address delivered from your browser and shortened by Google Analytics will not be combined with other data of Google.

b) Google Ads

Our websites use Google Ads, a web analytics service that uses advertising cookies. Google Ads also uses “cookies” stored on your computer that allow analysis of your use of the website. Google Ads also creates a Remarketing Tag to retarget a user via Google Ads, which is an advertising cookie. It helps us in understanding what actions users are taking and in targeting them more specifically based on their interests and actions. We can’t see any individual information of the users, it just gives us an option to retarget the groups of people that have taken certain action. We access this information through Google Analytics and Google Data studio. The information generated by the cookie about your use of this website is transmitted to a Google server in the US and stored there. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators, and providing other services related to website activity and internet usage. Google may also transfer this information to third parties if required by law or in so far as third parties process this data on behalf of Google. Google will in no case connect the data with other data from Google.

c) Facebook Ads Manager

Our online activities include the usage of the “Facebook Pixel” developed by Facebook, Inc. (1601 S. California Ave, Palo Alto, CA 94304, USA). This tool is an advertising cookie that makes it possible to track the behavior of users who have clicked on a Facebook ad and been directed to the website of the provider in question. The effectiveness of Facebook ads can then be assessed for statistical and market research purposes, which in turn can help optimize future advertising measures. The data we obtain through this process are anonymous, meaning it gives us no means of tracing the identity of any user – we can only target certain groups through Facebook Business manager. This information is stored and processed by Facebook on servers in the USA, in order to facilitate a connection to each user’s profile. Facebook can then use the data for its own advertising purposes in line with its data usage guidelines (https://www.facebook.com/about/privacy/). d) LinkedIn Campaign Manager

Our online activities include the usage of the “LinkedIn Insight Tag”, an advertising cookie, provided by LinkedIn Corporation (2029 Stierlin Court, Mountain View, CA 94043, USA). We use the LinkedIn Insight Tag to track conversions, retarget website visitors, and unlock additional insights about members interacting with our LinkedIn ads. The LinkedIn Insight Tag enables the collection of metadata such as IP address information, timestamp, and events such as page views. All data are encrypted. To track the advertising conversions, run retargeting campaigns and measure the effectiveness of our marketing activities, we are using the Pixel by ADITION Technologies AG. By accepting the cookies, you give consent for collection of data such as device, browser and usage information, IP address, click path, reference and conversions. The data is stored on the servers of ADITION Technologies AG, Düsseldorf.   • telephone
  • your message (required field)

The following information is also stored when you submit your message:

  • The user’s IP address

4. Legal basis for the data processing

The legal basis for processing data sent to us by e-mail is Article 6, paragraph 1, item a) of the GDPR – consent of the data subject.

5. Purpose of data processing

The personal information provided on the input screen is used for the sole purpose of handling the contact request. Any other personal information processed during the transmission is processed to prevent misuse of the contact form and to ensure the safety of our IT systems.

6. Retention period

Personal data will be deleted as soon as they are no longer required for the purpose they were collected. Regarding personal information from the input screen of the contact form and personal information sent by e-mail, such information will be deleted when the respective conversation with the user is terminated. A conversation is considered terminated when the circumstances indicate that the subject under discussion has been fully clarified. Any further personal information collected during the transmission will be deleted no later than within a period of seven days. After that, personal data might be stored only for the period indicated by provisions of law or as long as you or us may assert any claims towards each other, in which case, we are relying on our legitimate interest as the legal basis for this type of data processing.

Our website offers users the option to register by providing personal information via HubSpot form (e.g., in order to register for events/webinars or career events). During that process, information is entered on an input screen and transmitted to us in encrypted form and stored. The information is not shared with third parties outside the group of companies. The following information is collected during the registration process:

  • Form of address (required field);
  • First name (required field);
  • Last name (required field); and
  • E-mail (required field).

Further personal information may be requested depending on the event.

4. Legal basis for the data processing

The legal basis for processing information once the user’s consent has been obtained is Article 6, paragraph 1, item a) of the GDPR – consent of the visitors of the website during the registration process.

5. Purpose of data processing

User registration is required for the purpose of provision of certain content and services on our website, such as:

  • Registering for events or career events (e.g., university fairs); or
  • Publication requests (e.g., customer magazines, studies or whitepapers).

  • the end of the event or withdrawal of consent;
  • the resignation from receiving publications; or

3. Description and scope of the data collection

We operate publicly available profiles in social networks to get in touch with active users, interested parties and customers and to inform them about our services.

Data of social network users like Facebook or Google + may be processed in third countries – for example the USA. Therefore, the enforcement of the user’s rights can be more difficult. In that case, personal data will be transferred to the USA based on Article 46 paragraph 2 item c) of the GDPR – standard data protection clauses adopted by the European Commission.

If you are logged into your social media account and visit our social media presence, the operator of the social media portal can assign this visit to your user account. Your personal data can possibly also be collected if you are not logged into or do not have an account with the respective social media portal. This data collection is due to cookies saved on your device or the record of your IP-address.

With the collected data, the operators of the social media portals can create user profiles in which their preferences and interests are saved. Normally, the data are saved for market research and advertisement. In this way, personalized advertisement can be shown to you within and outside the respective social media presence.

If you have an account with the respective social network, the interest-related advertisement may be shown on all devices and platforms where you are or were logged onto.

Data directly collected by us through social media presence will be deleted from our systems as soon as the purpose of the storage is invalid, you ask for deletion, you retract your consent for storage or the purpose of data storage is invalid. YouTube videos are embedded into our website. Operator of the relevant plugins is YouTube LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. It works with the double click procedure. At first, our website just shows a thumbnail without establishing a connection to YouTube. When clicking on the thumbnail, a connection to YouTube will be established and your IP address will be transferred to the YouTube servers. YouTube will be informed that our website has been visited with your IP address. We do not receive information about these data and their use.

YouTube LCC is a subsidiary of Google LCC based in 1600 Amphitheatre Parkway, Mountain View, California, USA.

If you are logged onto your YouTube or Google account, Google can add the processed data to your account and treat them as personal data. This depends on your account settings (https://www.google.de/policies/privacy/partners/).

We embed YouTube videos into our website which allows you to watch them directly. By integrating external videos, we relieve our servers and can use corresponding resources elsewhere in order to increase the stability of our servers.
